REF: VEHICLE-RENTAL-SELF-DRIVE-AGREEMENT SELF-DRIVE VEHICLE RENTAL AGREEMENT
THIS AGREEMENT FOR HIRE OF SELF-DRIVE MOTOR VEHICLE is executed on this [Agreement Date] (the "Execution Date"):
BETWEEN:
[Vehicle Owner / Rental Agency Name], having its office or place of business at [Owner / Agency Office Address] (hereinafter referred to as the "Owner / Rental Company", which expression shall include its successors and assigns) of the FIRST PART;
AND:
[Renter / Hirer Full Name], residing at [Renter Residential Address], holding valid Indian Driving License No. [Renter Driving License Number] (hereinafter referred to as the "Renter / Hirer", which expression shall include their legal representatives) of the SECOND PART.
WHEREAS:
A. The Owner is the registered proprietor or authorized operator of the motor vehicle described herein, licensed under the Rent a Cab Scheme 1989 framed under the Motor Vehicles Act 1988.
B. The Renter desires to hire the vehicle for personal self-drive travel for the specified rental term, and warrants having valid driving qualifications.
NOW, THEREFORE, THE PARTIES MUTUALLY AGREE AS FOLLOWS:
1. PARTICULARS OF VEHICLE AND RENTAL PERIOD
1.1 Vehicle Particulars: Make and Model: [Vehicle Make and Model], bearing Registration No. [Vehicle Registration Number].
1.2 Rental Term: The hire term begins on [Rental Commencement Date] at the handover hour and expires on [Rental Termination Date] at the scheduled return hour, unless extended by mutual written consent.
1.3 Handover Condition: The vehicle is delivered in clean, roadworthy mechanical condition, equipped with spare wheel, jack, toolkit, and valid statutory documents (Registration Certificate, PUC, and Insurance).
2. RENTAL TARIFF, SECURITY DEPOSIT, AND FUEL
2.1 Daily Rental Consideration: The Renter shall pay a daily hire tariff of INR [Daily Rental Tariff (in INR)]/- for each 24-hour rental day.
2.2 Security Deposit: The Renter has paid a refundable security deposit of INR [Refundable Security Deposit (in INR)]/- prior to physical vehicle handover. The deposit shall be returned within seven (7) business days following vehicle return, after deducting any unpaid tolls, traffic challans, fuel deficits, or damage costs.
2.3 Distance Limit: The rental includes a travel allowance of: [Daily Distance Allowance & Excess Rate].
2.4 Fuel Terms: The vehicle fuel replenishment is governed by: Full-to-Full. If returned with a lower fuel level under Full-to-Full policy, refuelling costs plus a 15% service charge shall be deducted from the security deposit.
3. RENTER OBLIGATIONS AND SAFE OPERATION
3.1 Qualified Driver: The Renter warrants that vehicle [Vehicle Registration Number] shall be driven solely by [Renter / Hirer Full Name] holding Driving License No. [Renter Driving License Number]. The Renter shall not permit any third party, minor, or unlicensed individual to operate the vehicle.
3.2 Prohibited Usages: The Renter shall NOT:
(a) Drive the vehicle under the influence of alcohol, drugs, or intoxicating substances (Section 185, Motor Vehicles Act 1988);
(b) Sub-lease, pledge, or use the vehicle for commercial taxi service, racing, towing, or off-road rallying;
(c) Transport contraband, narcotics, illegal arms, or hazardous cargo;
(d) Exceed statutory speed limits (maximum 80 km/h or statutory highway caps).
3.3 Territory Limits: The vehicle shall be driven strictly within the borders of India and shall not enter prohibited border zones or restricted sanctuaries without prior permit endorsements.
4. INSURANCE, DEDUCTIBLES, AND TRAFFIC CHALLANS
4.1 Insurance Coverage: The vehicle is covered under: [Insurance Cover & Damage Deductible].
4.2 Forfeiture of Insurance Protection: If damage occurs while the Renter is driving under the influence of alcohol, driving in the wrong direction, or committing a criminal offence, all insurance cover is voided, and the Renter shall be personally liable for 100% of the replacement or repair cost and third-party liabilities.
4.3 Traffic Violations: All traffic police e-challans, overspeeding fines, red light jumping penalties, and parking violation notices incurred between [Rental Commencement Date] and [Rental Termination Date] belong solely to the Renter and shall be deducted from the deposit or recovered through legal process.
5. DAMAGE, BREAKDOWN, AND RETURN POLICY
5.1 Damage Assessment: Handover inspection and damage liability are governed by: [Vehicle Damage and Repair Deduction Policy].
5.2 In the event of a mechanical breakdown or road collision, the Renter must notify the Owner immediately. The Renter shall not abandon the vehicle or authorize uncertified roadside repairs without written authorization.
5.3 Late Return Penalty: Returning the vehicle past the scheduled return hour on [Rental Termination Date] without prior approval shall attract a late penalty equal to twice the pro-rata hourly tariff.
6. INDEMNITY AND DISPUTE JURISDICTION
6.1 The Renter agrees to defend, indemnify, and hold harmless the Owner from any claims, MACT court proceedings, vehicle impoundment costs, or legal damages arising from the Renter's operation of vehicle [Vehicle Registration Number].
6.2 Jurisdiction: This Agreement shall be governed by the laws of India, and any disputes shall be submitted to the exclusive jurisdiction of the civil courts located at [Owner / Agency Office Address].

SCHEDULE OF TERMS, COVENANTS & CONDITIONS(6 ACTIVE CLAUSES)
1. TENURE & TERM OF LEASE: The term of this lease/tenancy shall be for a fixed duration of {{duration_months}} months commencing on {{commencement_date}} and terminating on {{expiry_date}} unless renewed by mutual consent.
2. MONTHLY RENT & DUE DATE: The Second Party covenants to remit a monthly rent of Rs. {{monthly_rent}} payable in advance on or before the {{rent_due_day}} day of each calendar month.
3. REFUNDABLE SECURITY DEPOSIT: The Second Party has deposited an interest-free refundable security sum of Rs. {{security_deposit}} with the First Party, returnable within 7 banking days of vacant handover.
4. PERMITTED USE OF PREMISES: The demised premises shall be utilized exclusively for lawful residential dwelling purposes and shall not be converted into commercial or industrial use.
5. STATUTORY ARBITRATION (ACT 1996): Any dispute arising hereunder shall be referred to a sole arbitrator appointed mutually under the Arbitration and Conciliation Act, 1996, with seat of arbitration in the execution city.
6. SUB-LEASE & ASSIGNMENT PROHIBITION: The Second Party is strictly prohibited from sub-letting, parting with possession, or assigning any portion of the premises to third parties without prior written consent.
