REF: BIKE-MOTORCYCLE-RENTAL-AGREEMENT BIKE AND MOTORCYCLE RENTAL AGREEMENT
THIS TWO-WHEELER RENTAL AGREEMENT is executed on this [Agreement Date] (the "Execution Date"):
BETWEEN:
[Bike Rental Agency / Owner Name], having its commercial bike rental outlet at [Agency Office Address] (hereinafter referred to as the "Owner / Rental Agency", which expression shall include its partners, managers, and permitted assigns) of the FIRST PART;
AND:
[Renter / Rider Full Name], residing at [Renter Residential Address], holding valid Indian Two-Wheeler Driving License No. [Renter Driving License Number] (hereinafter referred to as the "Renter / Rider", which expression shall include their legal representatives) of the SECOND PART.
WHEREAS:
A. The Owner operates a commercial two-wheeler rental agency licensed under the Rent a Motorcycle Scheme 1997 framed under the Motor Vehicles Act 1988.
B. The Renter desires to hire the motorcycle described below for self-drive travel between [Rental Start Date] and [Rental Return Date], and certifies possessing the required driving competence.
NOW, THEREFORE, THE PARTIES MUTUALLY AGREE ON THE FOLLOWING TERMS:
1. MOTORCYCLE IDENTIFICATION AND RENTAL TERM
1.1 Two-Wheeler Particulars: Make and Model: [Motorcycle Make and Model], bearing commercial registration plate [Two-Wheeler Registration Number].
1.2 Rental Duration: The hire period commences on [Rental Start Date] at the handover hour and ends on [Rental Return Date] at the scheduled return hour.
1.3 Handover Condition: The Owner delivers the motorcycle in clean, mechanically sound running condition with working headlamps, indicators, horn, front/rear disc brakes, and valid digital copies of the Registration Certificate, Insurance, and PUC.
2. TARIFF, SECURITY DEPOSIT, AND FUEL RULES
2.1 Daily Rental Charge: The Renter shall pay a daily hire tariff of INR [Daily Rental Fee (in INR)]/- for each 24-hour cycle.
2.2 Security Deposit: The Renter has deposited a refundable security deposit of INR [Refundable Security Deposit (in INR)]/- with the Owner. This deposit shall be refunded upon safe return of the motorcycle, after deducting any unpaid fuel charges, excess mileage, or repair assessments.
2.3 Kilometre Limit: The hire includes a daily distance allowance of: [Daily Distance Limit and Extra Mileage Fee].
2.4 Fuel Replenishment: Fuel return terms shall strictly adhere to: Full-to-Full.
3. HELMET SAFETY AND TRAFFIC COMPLIANCE
3.1 Mandatory Helmet Usage: In strict compliance with Section 129 of the Motor Vehicles Act 1988, both the rider and pillion passenger must wear protective headgear at all times. The equipment status under this contract is: Yes - 2 ISI Marked Helmets.
3.2 Pillion Riding Limit: The Renter covenants that the two-wheeler shall never carry more than one pillion rider (maximum two persons total on the motorcycle). Tripling is strictly prohibited.
3.3 Sobriety Warranty: The Renter shall never operate the motorcycle under the influence of alcohol, drugs, or illicit narcotics (Section 185, Motor Vehicles Act 1988). The Owner reserves the right to immediately confiscate the vehicle without refund if the Renter is observed driving while intoxicated.
4. DAMAGE ASSESSMENT, ACCIDENTS, AND INDEMNITY
4.1 Physical Damage Policy: Handover inspection and damage recovery are governed by: [Damage Assessment and Repair Liability].
4.2 Punctures and Minor Maintenance: Day-to-day tyre punctures and chain lubrication during the rental period shall be attended to and paid for by the Renter.
4.3 Traffic Challans: The Renter is solely responsible for all automated traffic police e-challans, overspeeding fines, red light jumping penalties, or no-parking towing charges incurred between [Rental Start Date] and [Rental Return Date].
4.4 Third-Party Accidents: In the event of an accident, collision, or third-party injury, the Renter shall immediately inform the Owner and cooperate in filing any necessary police reports. The Renter shall defend and indemnify the Owner against all MACT tribunal awards, impoundment costs, or criminal liabilities arising from rider negligence.
5. RESTRICTED TERRITORY AND PROHIBITED ACTIVITIES
5.1 The motorcycle shall be ridden strictly on metalled public roads within the designated state perimeter. Riding on beach sands, water streams, forest trails, or off-road rocky terrain is strictly prohibited.
5.2 The Renter shall not participate in road races, speed trials, stunt riding, or use the vehicle for commercial package delivery.
5.3 The Renter shall not sub-let, lend, or transfer physical control of the motorcycle to any third party.
6. RETURN OF MOTORCYCLE, DELAY, AND TERMINATION
6.1 The Renter shall return the motorcycle, keys, documents, and provided helmets to [Agency Office Address] on or before the return hour on [Rental Return Date].
6.2 Late Return Fee: Delays exceeding one (1) hour without prior written permission shall be charged at a late fee of INR 200 per hour up to six hours, beyond which a full extra day's tariff shall apply.
6.3 The Owner may terminate this agreement and repossess the motorcycle immediately without notice if the Renter breaches safety, legal, or payment terms.
7. GOVERNING LAW AND DISPUTE JURISDICTION
7.1 This Agreement is governed by the laws of India, including the Indian Contract Act 1872 and the Motor Vehicles Act 1988.
7.2 All disputes arising out of this contract shall be submitted to the exclusive jurisdiction of the civil courts having territorial jurisdiction over [Agency Office Address].

SCHEDULE OF TERMS, COVENANTS & CONDITIONS(6 ACTIVE CLAUSES)
1. TENURE & TERM OF LEASE: The term of this lease/tenancy shall be for a fixed duration of {{duration_months}} months commencing on {{commencement_date}} and terminating on {{expiry_date}} unless renewed by mutual consent.
2. MONTHLY RENT & DUE DATE: The Second Party covenants to remit a monthly rent of Rs. {{monthly_rent}} payable in advance on or before the {{rent_due_day}} day of each calendar month.

5. STATUTORY ARBITRATION (ACT 1996): Any dispute arising hereunder shall be referred to a sole arbitrator appointed mutually under the Arbitration and Conciliation Act, 1996, with seat of arbitration in the execution city.
6. SUB-LEASE & ASSIGNMENT PROHIBITION: The Second Party is strictly prohibited from sub-letting, parting with possession, or assigning any portion of the premises to third parties without prior written consent.
